CONTINENTAL STANDARD WARRANTY POLICY - TBR

“CIPL” refers to Continental India Pvt. Ltd. Having its registered office at 11th Floor, Tower B, Vatika Mindscapes, Near Sarai Metro Station, Sector 27 D, Faridabad, Haryana-121003

Every effort is made by CIPL to ensure the highest possible standards of both material and workmanship. Subject to the terms and conditions set out herein, CIPL hereby warrants that the tyres supplied to its Customer (references to “Customer” under this policy refers to purchasers of CIPL tyres) are warranted against failure as a result of any inherent deficiency relating to materials or workmanship.

1. PRODUCT COVERED & TERRITORY

  1. CIPL Truck & Bus Radial (TBR) Tyres used in normal service and in accordance with the product application recommendations of CIPL, are covered by a warranty against inherent defects in workmanship and materials subject to the conditions set out below.
  2. The tyres covered by this warranty policy must be tyres purchased from an authorized CIPL dealer in India and the tyres were billed by CIPL to authorized dealer and the tyres must have been used in normal service.

2. DURATION OF WARRANTY

  1. For the Indian market, the applicable warranty period for TBR (Truck & Bus Radial Tyres) is 5 years from the week of production
  2. The week of production is indicated on the sidewall of the tyre as follows:
  3. Complaints under this warranty shall not be processed if they are made outside of the relevant periods stated in paragraph 2.1 above.
  4. These Warranties applies only to the tires supplied by CIPL to it’s authorized dealers. Proof of purchase is required.

 3. CONDITIONS OF WARRANTY

The warranty shall not cover tyre failure and/or damage to the tyre arising out of circumstances beyond CIPL’s control which include but are not limited to the following:

  1. Tyre damage/failure due to willful or negligent abuse of the tyre or as the result of external causes or road hazards damage (such as punctures, impact ruptures, cuts, snag, bruise, damages/bead rupture, repairs).
  2. Tyre failure due to incorrect mounting, usage or wheel imbalance.
  3. Mechanical irregularity in vehicle or such as wheel or axle misalignment resulting irregular wear, rapid wear, damages to under-tread, carcass or steel belts.
  4. Under inflation or over inflation of the tyre, against the recommended inflation pressure.
  5. Repaired tyres.
  6. Loading the vehicle beyond the recommended capacity of the vehicle (Government of India Axle Load Norms) or the load index marked on the tyre sidewalls.
  7. Improper application.
  8. Improper tyre storage conditions resulting in damages to tyres.
  9. Modifications in Vehicle which is not in line with the recommendations laid down by Government of India
  10. Other external causes such as accidents, collisions, fire or other actions or events beyond CIPL’s control.
  11. Excessive scoring on Sidewall due to lose vehicle parts or road curbs

For the avoidance of doubt, normal wear and tear of the tyre does not constitute an inherent deficiency in the materials or workmanship of the tyre.

4. WARRANTY CLAIM

  1. To make an eligible claim under this Standard Warranty Policy, consumer must visit, along with the complaint tyre to an authorized CIPL dealer who will help file the case along with all the mandatory descriptions.
  2. Any Adjustment made under this warranty policy will only be considered upon inspection of the tyre by a technical customer service representative of CIPL and such determinations made will be binding. Adjustments made will be based on Prorata basis. All applicable taxes and local duties are the responsibility of the buyer.
  3. Tyres presented for complaint remain the property of the consumer/owner and Continental do not take over responsibility for damages to, or loss of tyres which are in the control of a Continental authorized dealer for inspection to potential warranty adjustment. Once the complaint is adjusted, the complaint tyres become the property of Continental.

For the avoidance of doubt, this warranty shall not cover or include Any incidental and consequential damage such as towing, vehicle rental charges, hotel charges, loss of time, inconvenience, loss of use of vehicle, commercial loss or loss by any other reason.

5. GENERAL QUALIFICATION

  1. This warranty policy shall be governed by and construed in accordance with the laws of India and parties submit to the exclusive jurisdiction of the courts of India.
  2. Otherwise than as expressly provided herein, CIPL does not make any other representation or warranty or guarantee regarding any other aspect of the tyres.
  3. CIPL will not be liable for claims and/or damages arising out of (i) the circumstances set forth in Clause 3; (ii) any delays caused by the Customer’s failure to present the warranty claim in accordance with this warranty policy and/or (iii) any loss of profits, loss of business, depletion of goodwill or similar losses, loss of anticipated savings, any special, indirect, consequential or pure economic loss, costs, damages, charges or expenses.
  4. If any provision of this warranty policy shall be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other provisions of this policy which shall remain in full force and effect.

  • CIPL reserves the right to make any modification / alteration in this policy from time to time and thereafter intimate the same to all concerns.
  • The company should not be held liable for any assurance, commitment, representation, promise or agreement made by its dealers or authorized representatives etc that contradicts or deviate from any of the terms and condition mentioned in this policy.
